1. Introduction

Firstly, a big thank you for your interest in The Big NOAH Silverstone Sleepout 2025.

By taking part you will be making a very valuable contribution towards ending homelessness in Luton and Bedfordshire and help with the day to day running costs of NOAH Enterprise (NOAH) as well as having the opportunity to spend time at the iconic Silverstone Racetrack.

The next few pages should tell you everything you need to know about the terms & conditions of the Event, the not so small print, but if there is something missing, or you have any questions, please contact us at [email protected]

Please bear in mind that NOAH reserves the right to change the terms & conditions without notification to you and you should periodically visit this page to review the terms & conditions.


2. Event Terms & Conditions

The Event

2.1. The Event is hosted by NOAH and is intended to;

a. Raise money to support the ongoing costs of running the Charity in support of the Homeless and those experiencing extreme poverty.

We will make sure the money you raise goes to helping where its most needed, including, but not limited to;

· Providing food to our service users at our Welfare Centre in Luton.

· Offering Outreach Services

· Delivering practical training and development courses to prevent people falling into homelessness,

· Supporting our core running costs, marketing, fundraising, Retail, and e-Commerce operations.

· Help special projects, for example working with Veterans, women and families and holding Severe Weather Emergency Protocol (SWEP) Winter shelter.

b. Raise awareness about homelessness and poverty by introducing participants to the experience of homelessness for one night. We aim to give you an as realistic as possible experience, all be it at a fabulous venue. You will hear from NOAH employees with Lived Experience, about the reality of what its like to be Homeless.

2.2 The Event requires participants to sleep (or try to!):

a. Outdoors within “The Pitts” at Silverstone Racetrack.

b. Potentially exposed to the elements including rain; and

c. Without bedding other than a sleeping bag, pillow, and a cardboard sheet.

2.3 There may be media interest around the Event, by registering, you are agreeing for your name, photograph, and/or footage of you to be used for promotional or advertising purposes. If you do not wish your involvement to be promoted, or for your photo or footage of you to be used, please make this known to the Event team upon registration.

2.4 A reception with light refreshments and drinks (alcoholic and non-alcoholic) will be held in the media centre prior to the sleepout. No alcohol is allowed in outdoor sleeping areas after the point of the reception. No alcohol to be brought to The Big Silverstone Sleep out.

2.5 The Event is not a social gathering, and participants are asked not to invite friends, family, or pets to come with them, or visit them at the Event.

2.6 NOAH reserves the right to determine or change the eligibility criteria for individuals and organisations participating in the Event at any time, and you should periodically visit this page to review the terms & conditions.

2.7 We ask that anyone participating in the Event lets us know as soon as possible if they need to withdraw from the Event for any reason.

2.8 If we need to change the Event venue and/or date, we will notify you of this change as soon as possible.

The Event place will be automatically transferred to the re-scheduled Event unless you tell us you are no longer able to attend. In these circumstances you can ask for a refund of your initial payment or you can choose to donate this NOAH.

2.9 If we need to cancel the Event, we will notify you of this cancellation as soon as possible. Where possible, we will transfer you to another Event. If we are unable to transfer you and/or you are no longer able to attend, you can ask for a refund of your entry fee or you can choose to donate this to NOAH.

2.10 We reserve the right to reduce or alter the itinerary of the Event to accommodate any unexpected complications on the night that may have an impact on NOAH staff, participants, volunteers, and other attendees.

2.11 All participants should be over the age of 16, If you are the parent or legal guardian of a child under the age of 18, by registering or allowing your child to be registered, you are consenting to these Term’s & Condition’s and you are agreeing to their participation under your/an accompanying adult’s direct supervision.

Under your supervision or under an accompanying adult’s direct supervision, you/they will make sure your child participants are appropriately equipped e.g. warm clothing, sleeping bags etc. and complete any and all necessary declarations e.g. health declarations, on behalf of your child participants.

2.12 All participants/attendees are responsible for making sure they are wearing appropriate attire e.g. warm clothes etc, and have appropriate equipment e.g. sleeping bags etc. when taking part in the Event, taking into account the nature of the Event, the weather forecast and sleeping outdoors involved.

2.13 We must hold contact details for all participants in advance in case of an emergency.

2.14 We must have verification of each participants identity in advance of the Event e.g. Drivers Licence, Passport, Birth Certificate, and reserve the right to conduct relevant and appropriate checks, as necessary, ensure you bring this with you on the night of the event.

2.15 If anyone arrives late for the Event, they must follow the instructions and decisions of the Event Manager or their representative at the entrance to the Event. For health and safety reasons it is possible that latecomers may not be permitted to take part.

3. Your Participation

3.1 By registering as a participant in the Event:

a. You are agreeing to raise a minimum of £1,000 for NOAH via sponsorship, donation, or a combination of both. Or:

b. An initial payment of £250 and the remaining amount of £750 raised via sponsorship, donation, or a combination of both.

Initial payments are non-refundable unless we change the Event venue and/or date, or if we cancel the Event altogether.

3.2 NOAH reserves the right to withdraw any participant from the Event at our discretion if they do not raise the minimum amount required.

3.3 So that we can keep track of how many people are attending the event e.g. for catering and security purposes, and to check how close you are to achieving the target of £1,000 (hopefully more!) you must;

a. Register for the Event to be eligible to take part in the Event. Register at The Big Silverston Sleepout confirming which one of the options at 3.1 above you are going to aim for.

By registering you confirm that you have read and accept these Term’s & Condition’s.

By continuing to be registered, you will be deemed to have consented to and accepted any amended terms and conditions with effect from the date of the amendment.

b. Create a fundraising page via NOAH’s Just Giving page https://www.justgiving.com/campaign/thebigsilverstonesleepout 

3.4 You have a legal responsibility to ensure that all sponsorship/donation money you receive personally for the Event is paid to NOAH, and we ask that you do this as soon as possible after your Event. You can:

a. Use an online fundraising platform, E.G. Just Giving, in which case funds will be automatically paid to NOAH.

b. Pay in your sponsorship/donation money online with your credit or debit card or message us at [email protected]

c. Send a cheque made payable to NOAH Enterprise (stating your full name, your unique reference number provided in your registration confirmation email on the reverse of the cheque) to: NOAH Enterprise, The Welfare Centre, 141 Park Street, LUTON. LU1 3HG.

d. Please note that we cannot accept sponsorship money from you at the Event as we do not have the suitable cash handling facilities to do so.

3.5 You agree not to make out that your actions are on behalf of NOAH, to the extent that you make representations for fundraising or Event purposes, NOAH, takes no responsibility for those representations.

3.6 Acknowledge that you participate at your own risk and that you are not, to the best

of your knowledge, suffering from a condition which would prevent and/or render

you unfit to participate in the Event.

You agree to take all reasonable measures to protect yourself from the risks of

participation.

3.7 You are responsible for all property that you bring to the Event, NOAH accepts no responsibility for loss or damage to this property.

3.8 You agree not to cause any loss or damage to property at the Event.

3.9 You and/or your organisation agree that your data may be used by NOAH for future marketing, events, and campaigns.

4.Use of logo

4.1 NOAH grants the non-exclusive permission for you and/or your organisation to have the non-exclusive right to use The Big Sleepout logo solely for the purpose of advertising, display, and promotion of your fundraising efforts for The Big Sleepout event. This permission is given on the condition that you and your organisation agree to use The Big Sleepout logo in accordance with the artwork and resources provided on the Event micro-site/website without alteration or distortion. This permission is not transferable.

4.2 Non-Transferability: You and/or your organisation agrees not to transfer or sublicense the right to use The Big Sleepout logo to any third party without prior written consent from NOAH.

4.3 All logos and slogans are subject to copyright obligations NOAH and, along with all information, text, graphics, advertisements, audio and multimedia found on the micro-site/website (in whole or in part) are not to be copied, reproduced, reused, reposted, repurposed, transmitted, adapted, republished, broadcast, distributed or uploaded without written authorised permission.

4.4 The information on the micro-site/website has been provided for personal, non-

commercial use only, to provide information on the services provided by NOAH.

5.Disclaimer

While sleeping out in the cold is not a comfortable experience, the risk of serious injury or illness is relatively low. However, if you foresee any adverse health implications for yourself, please reconsider participating and donating to the event instead.

By taking part you are acknowledging that accidents may occur and accept all risks relating to or arising from your participation in the Event and release the Event Organisers and all related persons associated with the conduct of the Event from all liability relating to or arising from your participation in the Event.

We reserve the right to refuse entry to the Event at our absolute discretion, with no refund provided, if for whatever reason we consider you are unfit to take part. We may also ask you to withdraw during the Event if we have concerns about your ability to complete it due to fitness, injury sudden illness or otherwise. If you choose to continue in the Event despite this request you do so on the understanding that you are no longer considered a participant of the Event and that you absolve NOAH of all and any responsibility (as far as permitted by law), and stay entirely at your own risk. Emergency services may be called.

6. Use of Your Information, and Anyone You Register

6.1 When you register for the Event, we collect personal data relating to you and anyone else that you register. We will use this information for the purposes of organising, staging, and administering the Event, including to send you anything we need to about the Event, and additional information about fundraising. If you provide personal information on behalf of additional participants, please only provide this if they have confirmed that they are happy for you to do so as we will use this information for the same purposes.

6.2 Following your registration, we may contact you with information about the Event, including to discuss ways to improve your fundraising and hints and tips to support your preparation for the event. This may include information about how you can get hold of NOAH merchandise and offers from our partner organisations.

6.3 In the case of an emergency, we may pass the personal details provided by you when you registered for the Event to the emergency services or health care professionals, and also for the purposes of contacting your emergency contact.

6.4 First aid facilities will be provided at the Event. If you are treated by medical providers at the Event, your details will be passed on to us only for health and safety purposes and in order to fulfil our legal obligations (including those under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013). All accident details will be held in the NOAH Accident Book in line with statutory requirements.

6.5 Subject to the marketing preferences we hold for you, your personal data may also be used for the purposes of sending you information about how you can support NOAH’s work and details of our future events if this is something you have confirmed you would like to hear from us about.

6.6 All personal data held by us will be handled in accordance with applicable privacy laws and NOAH’s privacy statement which can be found here .

7. Accessibility & Complaints

7.1 Accessibility The Event is open and accessible to all. If you have accessibility needs or require reasonable adjustments, please contact [email protected] at least four weeks before the Event.

7.2 Complaints Procedure To raise a complaint, email [email protected]. We will acknowledge within 14 days of receiving it and aim to resolve within 30 calendar days.

If it will take longer than 30 calendar days, we will notify the complainant, detailing the reason for the delay, and provide a new deadline.

8. Filming and Photography at the Event

8.1 Please note that we (or our authorised service providers and agents) or our commercial partners may film or photograph participants, volunteers and spectators taking part or attending the Event and use such footage or photographs for the following reasons:

a. to publicise the Event for commercial and/or fundraising purposes including, but not limited to, television broadcasts, advertising, publications, marketing material, merchandising, and other documents that may be made available to the public; and

b. for our commercial partners to publicise their involvement and/or association with the Event.

8.2 No personal details (including names) of any under 16-year-old participants will be used in any publicity materials without the written consent of their parent or legal guardian, but we may use images where children are incidentally included e.g. of mass participation in an energiser or on the starting line.

8.3 Subject to 8.2 above, please only register a participant who is under the age of 16 if the participant and/or parent/legal guardian (as applicable) are happy for their images to be used in the manner described in these Rules.

9. Liability

9.1 Use of the NOAH website is subject to our website terms and conditions, See section 10.

9.2 You enter, attend and participate in the Event entirely at your own risk, We (NOAH’s trustees, directors, officers, employees, volunteers, contractors, sponsors and/or agents) (collectively, the Event Organisers) will not be liable for any injury, damage or loss to you or your property that might occur as a result of your participation in or attendance at the Event, other than in respect of any injury or loss arising as a result of our negligence. For the avoidance of doubt, nothing in this Section shall exclude or limit our liability for any liability that cannot be excluded or limited by law.

10.Website Terms & Conditions

10.1 NOAH may remove any content posted by you, prevent access by you to the website and/or prevent you from participating in the event if you do not comply with these terms & conditions. The terms & conditions are subject to the laws of the UK.

10.2 The micro-site and website are owned and operated by NOAH. Your access to both, and your participation in the event is conditional upon your acceptance of, agreement to and compliance with, the terms & conditions, notices, and disclaimers, including both website’s ‘Online Privacy Policies’.

10.3 By accessing the micro-site/website and/or registering for the event, you are deemed to have read and are bound to the unconditional acceptance and compliance with the terms & conditions set out below.

a. Information contained on the micro-site/website is as up to date as our resources permit and has been provided as complete and in good faith without any express or implied warranty.

b. NOAH is not liable for any costs or losses you incur through your use of the micro-site/website (including by accessing links to third party websites from the website).

c. The information is specific and relevant to the UK,

d. The micro-site/website may contain bulletin boards, chat rooms, forums or other communication facilities. By using and accessing the microsite/website, you agree that you will not do any of the following;

i. Post, communicate or transmit any unlawful, criminal, threatening, abusive, defamatory, libellous, contemptuous, obscene, vulgar, pornographic, profane or indecent material, including any material that would materially and adversely affect the reputation of NOAH.

ii. Post, communicate or transmit material which violates or infringes the rights of any other person or party or infringes any law.

iii. Inhibit or restrict any other user from using the micro-site/website.

iv. Interfere with the computer systems which support the micro-site/website, overload a service, engage in a denial-of-service attack or attempt to disable a host.

v. Post, communicate or transmit any file which contains viruses, worms, “Trojan horses” or any other harmful, contaminating or destructive features.

vi. Access or attempt to access information resources you are not authorised to use.

vii. Impersonate or falsely represent your association with any person or organisation or otherwise provide false or misleading information.

viii. Attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the micro-site/website, including the use of automated tools.

ix. Post, communicate or transmit or use any material of any kind for commercial purposes, or which contains any promotional material or advertising.

x. Delete, circumvent or alter any author attribution, legal notices, rights management information or technological protection measures; or

xi. Post, download, communicate or transmit any file or material posted by another user of the micro-site/website if you know, or reasonably ought to know, that the file or material cannot legally be downloaded or communicated in that manner.
